A Will looks after someone's estate when they die. But what happens in the intervening period if they become unable to look after their own affairs?
There are many things that can compromise our mental capabilities - Alzheimer's disease, dementia, stroke, coma. Should we be unfortunate to suffer these illnesses who would look after our affairs or our welfare?
Or to put it another way, who has LEGAL authority?
If someone loses the ability to make decisions for themselves, through losing their mental faculties, it is very difficult, time-consuming and costly for someone else to gain the legal authority to look after their affairs or their welfare on their behalf.
Having a Lasting Power of Attorney document written cuts through this process and allows the person to nominate people called Attorneys, who can step in and take over their affairs if necessary. In fact there are two Lasting Power of Attorney documents:
Property & Affairs - this allows you to appoint members of your family or friends - called Attorneys - to look after your financial affairs if you are unable to.
Personal Welfare - this allows you to appoint members of your family or friends - called Attorneys - to make decisions regarding your healthcare and your welfare in the event you are unable to make those decisions for yourself.
Both are very important 'insurance policies' which clients would do well to consider. After all, the cost of not having them could be substantially more if you have not made provision.

The document has to be signed when the person is mentally capable, so it is a document which needs to be drafted now: it cannot be written when it is too late and the person is no longer mentally capable.
